Terms and Conditions

These Terms and Conditions (“Terms”) govern the use of EventPesa (the “Platform”), operated by RubyPesa (“we”, “us”, or “our”). By accessing or using the Platform, you agree to be bound by these Terms.
If you do not agree with these Terms, do not use the Platform.
1. Platform Overview
EventPesa is an online platform that enables event organizers to create, publish, and manage events or conferences, and allows users to register for events, reserve seats, and purchase tickets, including options for pay-later where enabled by the organizer.
RubyPesa is a technology provider and is not the organizer of events listed on the Platform.
2. User Accounts
2.1 Account Creation
To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration.
2.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. Event Organizers
3.1 Organizer Responsibilities
- The accuracy of event details, pricing, schedules, and content
- Compliance with all applicable laws and regulations
- Delivering the event as advertised
- Managing refunds, cancellations, and attendee communications
3.2 Prohibited Events
Organizers may not list events that are illegal, misleading, fraudulent, or violate applicable laws or third-party rights.
4. Attendees and Ticket Purchases
4.1 Registration and Tickets
By registering for an event or purchasing a ticket, you enter into a direct agreement with the event organizer, not RubyPesa.
4.2 Payments and Platform Fees
RubyPesa facilitates payments on behalf of event organizers. A platform service fee of 7% is charged on each successful ticket purchase or payment made through the Platform. This fee is deducted at the point of payment and is non-refundable.
4.3 Pay-Later and Installment Payments
- Pay-later and installment terms are set by the organizer and clearly displayed on the event page
- Failure to complete payment within the specified timeframe may result in automatic cancellation of the reservation
- RubyPesa is not responsible for enforcing payment collection on behalf of organizers
- Tickets may remain invalid until full payment is completed
4.4 Refunds and Cancellations
Refund and cancellation policies are determined solely by the event organizer and must be clearly stated on the event terms page. RubyPesa does not issue refunds unless explicitly stated.
5. Fees
RubyPesa may charge service fees to organizers and/or attendees. All applicable fees will be disclosed before completing a transaction.
6. Platform Availability
We strive to ensure the Platform is available at all times but do not guarantee uninterrupted or error-free operation. We may suspend or modify the Platform at any time without notice.
7. Intellectual Property
All content and technology on the Platform, excluding organizer-provided content, are owned by RubyPesa or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Platform without permission.
8. User Content
Users and organizers retain ownership of content they submit but grant RubyPesa a non-exclusive, worldwide license to use, display, and distribute such content for Platform operations and marketing.
9. Limitation of Liability
To the maximum extent permitted by law:
- RubyPesa does not guarantee event attendance, quality, safety, legality, or delivery. All obligations related to the event rest solely with the event organizer.
- RubyPesa may assist with payment processing and dispute handling; however, liability for chargebacks, refunds, and event-related claims rests primarily with the event organizer, except where loss results directly from RubyPesa’s proven technical failure, system error, or breach of these Terms.
- RubyPesa is not liable for losses, delays, or failures caused by third-party payment processors, financial institutions, network outages, or circumstances beyond its reasonable control.
- To the extent RubyPesa is found liable, its total liability shall not exceed the total platform fees collected for the specific transaction giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless RubyPesa from any claims, damages, or losses arising from your use of the Platform or violation of these Terms.
11. Termination
We may suspend or terminate your account if you violate these Terms or misuse the Platform.
12. Changes to Terms
We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

Your use of the Platform is subject to the Privacy Policy here.
